After a lengthy conversation with ------- ------ of GIO, the General Insurance Ombudsman(or whoever you spoke to), I am writing this letter now...

  My TD Visa(or whatever credit card ) account number is ---- ---- ---- ----

  The name on the account is my maiden(or whatever name on the card) name ---- ---- ---- ----

I am married now, & use my married name Mrs. Sari Grove in conversation & online...( my financials I kept separate because I am a sel-employed visual artist & as such a relatively public figure...) (explain if your name is different on credit card)

 I discovered an unauthorized charge on my TD Visa about 2 months ago...When I called to have it removed, I was told it was for balance protection insurance...

  I later found out that $2,684.70(insert your number) was debited from my Td Visa card(insert your credit card name) over the years...Plus interest...

 I asked for a refund immediately of course...

 I was told that this balance protection insurance began on my TD card in January of 2001(insert correct date)...

 I have been forwarded to the TD Insurance ombudsman's department by the Td bank ombudsman, as you can see in one of their attached letters...(or whoever sent you to this department)

 I have spoken with Assurant Solutions/ABLAC the underwriter(find out who your underwriter is), who have also directed me to TD Insurance...

 I have spoken to or written to the FCAC, as well as the Minister of Finance department on the federal level, as well as the OHLI, & FSCO, & the Consumer Protection Agency of Ontario...(probably several others, but it is late to list all the departments I have interacted with so far...)(write anyone you have spoken or written to)

 I am sure you are already aware of concerns with the selling & administering of this particular insurance product...

 Of note, an annual confirmation required in the administering of this product would prevent people like me from not even knowing this product existed on their credit card...

 10 years(or however long) is an awfully long time to be paying for something without any annual confirmation check on the part of the insurance company, isn't it?

 The fact that I am self-employed(or disabled, or a student, or seasonal worker...) is an obvious exclusion for the majority of any "benefits" that this product deems to offer...But more importantly I am concerned that money has been taken from me in a manner concurrent with "unfair business practices"...

 The facts of the transaction from the: 1) activation or reactivation of credit card bundled with sale of balance protection insurance is unfair...These two entities must be separated...

2)The lack of exclusionary or refining questions in the phone conversation is an unfair business practice...ie: Are you self-employed? Oh, then you can't qualify or make a claim for job loss, disability...

3) The lack of a necessity for a signed confirmation of acceptance after the phone conversation...If a written form is sent but not read, then what is the use of that form? A customer has to receive the written form, read it, & understand it, & then sign it, to indicate informed consent...Once that form is signed & returned to the insurer, then one has something of a contract...Calling a phone recording a contract is an unfair business practice...Stating that it is sufficient to send a form, without requiring it to be signed & returned is an unfair business practice...

4)Negative option billing in a general sense is an unfair business practice...

5)Lack of an annual confirmation is an unfair business practice...

6)Not giving a customer a refund if they say they didn't know they had this product, didn't receive any written documentation, didn't qualify since they are self-employed, is an unfair business practice...

7)Putting a customer through lengthy ombuds-processes, lengthy waits for final letters that were promised but never written or sent(one month before it was admitted that nothing was ever written or sent), lengthy runarounds & statements that this is the wrong department after 6 weeks of speaking to one office, is an unfair business practice...

8)Selling an insurance product that costs 2 million a year to administer, but earns 20 million a year in revenue, though everyone worldwide in the insurance industry agrees it is a completely useless product o the consumer, is an unfair business practice...

9) Not answering forwarded emails, phone calls or letters...Is an unfair businss practice...

I am still looking for a refund/annulment of this bal.prot.ins. to my Td Visa card...

  Get, I didn't "get it...Just because someone sends you something in writing, & you see it & you read it, doesn't mean you "get" it...Which means your consent is not "informed"...Without "informed" consent, there is no contract between two people...If you are not of sound mind or body or not of sound mind AND body, then you may not be able to make informed consent either...If someone is trying to get you signed up for a contract & you are not of sound mind or body & they still sign you up & you didn't "get" the contract as in "understand how to cancel, or understand that you were being discriminated against because you were unemployed self employed disabled jobless or seasonal or temporary jobby worker, then you were not informed correctly & consent was not given correctly by you because you couldn't...The fact that you were solicited for something you could not benefit from, & the fact that you were solicited because you were at a weak moment in your life, indicates a predatory con artist, of the worst kind...Premeditated, to know that you were weak, too weak to refuse solicitation because you fell into the discriminated against categories in their insurance file statistics (I'm guessing the self-employed don't usually carry insurance, at least more than other people who work for companies who provide insurance takeaways from your income cheques weekly)...So, they find out who, who has a credit card is "weak", they find the time of year when they are weak (January 1, 2001 is when most people are recovering from a New year's party or lack thereof, either way a weak moment)...Then they solicit you with obfuscatory language that has a time limit so you can't ask questions...What is the time limit? Well, they are recording the phone conversation & the tape is only so long, or they have pressure to end it quickly so they don't spend too much money on tape or the tape runs out before the closer & they don't get the phone record...So because your time is cut short over the phone you can't ask enough questions & you feel the pressure sale of time & so you are polite & let them get away quickly without really informing you of all the terms...Why are you polite? because the call is bundled with a credit card sale & you want your credit card activated badly because you need it to pay for things & they know that...Self-employed people can now get employment insurance- it's called EI...It's a new thing...But back then it did not exist, back in 2001...Is that new thing retroactive? Post ex facto ? Could be...So you mean if self-employed people were not allowed to receive insurance benefits due to business loss at work, say a tool broke & you couldn't work till you made a new tool & lost a customer that way, but for a very long time, or you went into rehab & lost business 'cause people thought you had disappeared & went somewhere else for their art, then now you can make a claim in the "job loss" category which is now opened up to include "business loss"...

  Retro: is a law retroactive? In Canada civil law can be, criminal law cannot be...Commercial landlords can seize property to make up for tenants not paying rent over several months, residential tenants cannot have their goods seized in order to make up for rent mispayments...So in Canada, one can conclude, that commercial landowners are favoured, as well as criminals, insofar as the law favours the commercial landlord, & the criminal who will not be subjected to a post ex facto or retroactive law even though murder was just made illegal in your town After he killed someone yesterday...So he is declared  an innocent to Canada, because criminal law is not retroactive here... A word to the wise however- murder is already illegal here, so don't get your hopes up...You Will be convicted here now, if the urge seizes you...

 I found white powder on the surface of blue recycling bin in a dog park near to Park road & Bloor street...When I  got close to see what it was, I sniffed a little & it burned my nose...It appears to be a warfarin based rodent poison mixed with a talcum powder...Earlier that week, at Jesse ketchum school there was a bled out squirrel near to a dumpster behind the school that was found in plain view by someone walking their dog in the dog friendly area...Earlier this summer, I found a bled out raccoon on Mount Pleasant near to crescent street under the bridge...A female raccoon later on Rosedale valley road, & a baby raccoon on Moore avenue, east of Mt. Pleasant...

  It appears that City workers or somebody are putting out anit-coagulating rat poison on blue boxes & dumpsters...

  Initially I thought it was cocaine uncut or something related to drug dealing...But the fact that these animals' blood was very very leaky & runny, even after expiration, indicates to me a rodent poison...I think this is dangerous to humans & dogs & cats & of course other wildlife...I also think this is illegal as a practice in public park areas...If this is a garbage or blue bin worker acting independently they must be penalized & fined & punished & reprimanded...Jail time might also be appropriate...

Assurant Solutions, also known as ABLAC, American Bankers Life Assurance company of Florida, & Canada Premier Life Assurance, were all owned by AIG Canada, who was bought by BMO Bank of Montreal on April 1, 2009...Combined, AIG CANADA, through various arms & names, underwrote for TD Canada trust, RBC, Sears, Capital One & CIBC, & possibly others I am not aware of...

  I myself (Sari Grove), am out $2,684.70 plus interest...(My husband, Joseph Grove is also on that account)...It appears there are thousands more like us, just from looking at comments on the CBC marketplace site in 2009 when they did the documentary on balance protection insurance, as well on Ellen Roseman's site's comment, the financial watchdog, rip off report.com reports, & various other online sources...

  I was concerned that if we pursued this in small claims court, that we might be hurting others who were similarly taken, but did not have the ability to defend themselves...I am concerned that if we get a refund, through all of our hard work, that others will not also get a refund...I am aware that once we get a refund, if we do, that we might psychologically let it all go by- but others may not have been successful...

  What do you think? Do you think we could have success in a class action pursuit? Not even sure if TD Insurance, the issuer, should be the one named, or perhaps BMO, because they now own the underwriter AIG Canada's holdings? I became aware today that: The company recently completed an acquisition of AIG Life Insurance Company of Canada (AIG Life of Canada). From the 1st of April, 2009, the former AIG Life of Canada became BMO Life Assurance Company and adopted the BMO Insurance brand for all of its marketing, broker and customer communications. It is now operating within BMO's wealth management division, the Private Client Group. It should be noted that BMO Life Insurance which existed prior to the AIG acquisition still exists under a seperate distribution arm.

I noticed that: "...backed by Assuris in..."

My Td Visa balance protection policy (which I did not qualify for because I am self-employed, but was signed up for anyway) written by TD Insurance was underwritten by Assurant Solutions...Assurant is also known as ABAC American bankers Life Assurance of Florida...

ABlac/Assurant was owned by AIG Annuity...

Canadian Premier Life Insurance Company who underwrites this same balance protection insurance product for other banks here in Canada, is also owned by AIG...

Both companies, ABLAC/Assurant, Canadian premier Life Assurance of Canada, who underwrite this balance protection insurance on credit cards (a dud, fraudulent, scam product as everybody knows), were owned by AIG...

AIG Canada failed in the Canadian market & BMO bought it...

So BMO now owns the Canadian arm of AIG...

I have been seeking a refund on balance protection insurance in the amount of $2,684.70 plus interest, because the contract was void abinitio, because no one said over the phone that a self-employed person does not qualify for any of the benfits (except death which I would not agree to because a credit card balance outstanding does not follow to surviving relatives anyway as current card contracts stand without paying extra)...

So I cannot get a refund because the people who signed me up for this thing went broke...(AIG Canada)...For lack of better wording...

Assuris states they will help people whose insurance company has disappeared...

I am sure that they aren't giving me a refund because they were sold to BMO & BMO is not handling the outstanding debts of AIG Canada...

Well, maybe they are, but not me yet...

Can Assuris give me the refund that the AIG company cannot?

Or can Assuris cause BMO Insurance to give me restitution based on the fact that they bought AIG Canada, debtors & all?
