  The incidental exemption, or enrolling activity by the banks, is actually quite massive...

 Estimates are 2 million dollars a year per bank to administer, with a 20 million dollar profit per year...

 This is for the incidental enrolling...

 So the banks ARE selling insurance...

 That little afterthought exemption took $3,000.00 dollars out of my pocket...During the worst decade of my self-employed business life...

 There are probably tens of thousands of people like myself in Canada who were missold this exempted insurance by the bank, over the phone...

 Once you say yes over the phone, the money is automatically taken from your credit card without another word or any signed confirmation at all...

 Statistics on insurance state quite factually that in insurance "enrollment", the vast majority, over 90 per cent, of people who say yes to an insurance policy over the phone, do not or are not able to read or thoroughly understand/comprehend any written documentation that may or may not appear 10 days later in the mail...People who can say yes over the phone are not necessarily qualified to read or give informed consent to complicated & obfuscatory written insurance policies...

I have been through the entire ombudsprocess with the agencies mentioned...I have also attempted to use other intervention with other agencies not mentioned below...

 The insurance industry is making HUGE money on balance protection insurance...

As are the banks...

 Which is why I have not gotten my money back yet...They don't want to give it back...Even though they know that it is wrong...

 They all know they have taken money wrongly...But they are hurting too, so they have turned a blind eye...

 I have been in touch with a major Class Action law firm here in Canada...

 They are looking into a Class Action lawsuit against all the banks in Canada who have sold balance protection insurance...

 In The States & England this has happened already & ALL people sold a policy by a bank are getting a refund...ALL...ALL people who have EVER been sold a policy on a credit card by a bank...

 That is how bad this is...

Canada is the last country to correct this wrong...

It should be our government who initiates this action...Not a law firm...

But our government has been slow to act, because they are in bed with the banks...

The answers below sound good don't they?

But they are meaningless when one person attempts to jump through those hoops...

The incidental exemption is key...

Legislation is only regulating licensed insurers...

Nothing about the banks...

That is the loophole...It is a giant black hole loophole...

Hello,

 I was sold PPI by Toronto Dominion Bank in Toronto, Ontario, Canada...I paid in three thousand dollars Canadian currency on my Toronto Dominion credit card (TD) before finding out that self-employed people are actually excluded from making a claim...

 It has been 6 months now of pursuing the bank, the credit card company, the insurance company & various other ombudservices who claim to help, with no refund...

 I understand that your company is well schooled in getting refunds...I also understand that you have probably limited your scope to England...

 When PPI became known for its corruption in England, the product moved to the United States...When lawsuits began there it came to Canada...

Canadians are not as well versed as Americans or The British is lawsuits of this sort...

 Do you have any connections who work in Canada or who could help Canadians? 

 Or could you stick your nose into this in Canada from England?

 I have been getting people phoning me here for help, as I have published my problems online & people here think I am some sort of agent or lawyer...

 This PPI is an international embarrassment, with funds being embezzled from credit card customers worldwide for possible nefarious uses as only a nefarious group would

steal monies in this manner...(one would assume) (As opposed to blaming the banks directly, it appears that groups of people within banks are operating somewhat

independently of scrutiny, possibly because chains of command are too long)...

An international ruling on PPI would go a long way to helping people like me in countries where PPI is still being sold daily over the phone...An international ban on PPI

would be nice & would happily result in mass refunds worldwide...(one can only hope)...

Is there any pressure in this direction? If not, some from your end in England where PPI proliferated would be nice...One can only ask...

  A.V., Eco-House Rainsil 1 part mixed with Eco-House Primasil 9 parts, all in a one Litre can, makes a NO VOC , no volatile organic components, (no smell), eco-friendly-concrete sealer, that you can put in a spritz spray bottle & spray on your concrete sculptures...Or maybe mix in integrally to the cement?( which I haven't tried yet...)
  Also, the mineral silicate paints come in a can too! Small sample sizes or large but not too large to carry sizes! Mineral silicate paints are less than 5 % latex, which means that instead of latex they are based on sand, you know silicate means sand smushed into a glassy liquidy thing, so your paint will be more like stained glass than stained cow's hoofs boiled...(or whatever latex is made of these days- rubber tree plants maybe?)...p.s. This is the name of somebody...I am trying to remember this person's name...I am not sure whether I can publish this name or not so I won't...But thank you for your help anyways...Much appreciated...You know who you are...I will refer to you as Archimedes...(Pythagorus is too complicated for me to say, sorry)...

  Get, I didn't "get it...Just because someone sends you something in writing, & you see it & you read it, doesn't mean you "get" it...Which means your consent is not "informed"...Without "informed" consent, there is no contract between two people...If you are not of sound mind or body or not of sound mind AND body, then you may not be able to make informed consent either...If someone is trying to get you signed up for a contract & you are not of sound mind or body & they still sign you up & you didn't "get" the contract as in "understand how to cancel, or understand that you were being discriminated against because you were unemployed self employed disabled jobless or seasonal or temporary jobby worker, then you were not informed correctly & consent was not given correctly by you because you couldn't...The fact that you were solicited for something you could not benefit from, & the fact that you were solicited because you were at a weak moment in your life, indicates a predatory con artist, of the worst kind...Premeditated, to know that you were weak, too weak to refuse solicitation because you fell into the discriminated against categories in their insurance file statistics (I'm guessing the self-employed don't usually carry insurance, at least more than other people who work for companies who provide insurance takeaways from your income cheques weekly)...So, they find out who, who has a credit card is "weak", they find the time of year when they are weak (January 1, 2001 is when most people are recovering from a New year's party or lack thereof, either way a weak moment)...Then they solicit you with obfuscatory language that has a time limit so you can't ask questions...What is the time limit? Well, they are recording the phone conversation & the tape is only so long, or they have pressure to end it quickly so they don't spend too much money on tape or the tape runs out before the closer & they don't get the phone record...So because your time is cut short over the phone you can't ask enough questions & you feel the pressure sale of time & so you are polite & let them get away quickly without really informing you of all the terms...Why are you polite? because the call is bundled with a credit card sale & you want your credit card activated badly because you need it to pay for things & they know that...Self-employed people can now get employment insurance- it's called EI...It's a new thing...But back then it did not exist, back in 2001...Is that new thing retroactive? Post ex facto ? Could be...So you mean if self-employed people were not allowed to receive insurance benefits due to business loss at work, say a tool broke & you couldn't work till you made a new tool & lost a customer that way, but for a very long time, or you went into rehab & lost business 'cause people thought you had disappeared & went somewhere else for their art, then now you can make a claim in the "job loss" category which is now opened up to include "business loss"...

  Retro: is a law retroactive? In Canada civil law can be, criminal law cannot be...Commercial landlords can seize property to make up for tenants not paying rent over several months, residential tenants cannot have their goods seized in order to make up for rent mispayments...So in Canada, one can conclude, that commercial landowners are favoured, as well as criminals, insofar as the law favours the commercial landlord, & the criminal who will not be subjected to a post ex facto or retroactive law even though murder was just made illegal in your town After he killed someone yesterday...So he is declared  an innocent to Canada, because criminal law is not retroactive here... A word to the wise however- murder is already illegal here, so don't get your hopes up...You Will be convicted here now, if the urge seizes you...
